Terms and booking policy
The rules for booking, paying, cancelling and pausing, so we both know where we stand.
The short version
- Packages are paid monthly, in advance.
- Cancel or move a session with at least 24 hours' notice, or it counts as used.
- Sessions are used within the month they're paid for.
- Give a week's notice before your next month to pause, switch or cancel.
- Tell me about any injury or health condition before we train.
The full terms below apply if anything here is unclear.
1. About these terms
These terms apply when you book a trial session, buy a package, or use my client app. By booking or paying, you agree to them. "I", "me" and "my" mean Neil Leonard Smith, trading as Neil Leo Smith Personal Training. "You" means the client.
Nothing in these terms removes rights you have under laws that can't be excluded, including the Australian Consumer Law and consumer protection law in Thailand or wherever you live.
2. My services
- In-person training in Bangkok, at a partner gym in Sukhumvit or at your condo or office gym, in monthly packages of 4, 8 or 12 sessions.
- Online coaching: a program built for your gym, video form reviews, weekly check-ins, messaging and a monthly video call.
- A one-off trial session in person in Bangkok.
What each package includes is set out on the pricing page. All packages include access to the client app.
3. Trial sessions
- A trial is a single 60-minute in-person session, paid in full when you book.
- It's a one-off, with no commitment to buy a package afterwards.
- The same 24-hour cancellation rule applies. If you cancel with less notice or don't turn up, the trial fee isn't refunded.
- Trials are limited to one per person.
4. Prices and payment
- Prices are in US dollars and shown on the pricing page. I'm not registered for GST, so no GST is added.
- Packages are paid monthly, in advance, before your first session of the month. I accept bank transfer or card. You pay any bank, card or currency conversion fees.
- If a payment is late, I may hold your sessions and app access until it's paid.
- Gym entry fees, if the venue charges them, aren't included, and are paid by you.
- I may change my prices. I'll give current clients at least 30 days' notice, and the new price applies from your next month after that.
5. Sessions and booking
- In-person sessions last 60 minutes, including warm-up.
- We agree session times together in advance. Regular weekly slots are held for you while your package is active.
- Sessions are used within the calendar month they're paid for. Unused sessions don't carry over, except where I cancelled or where section 8 applies.
- If you arrive late, the session still finishes at the booked time. If you're more than 15 minutes late without letting me know, the session may be cancelled and counted as used.
6. Cancelling a session
- Cancel or reschedule with at least 24 hours' notice by WhatsApp or through the app, and we'll move it to another time in the same month.
- With less than 24 hours' notice, or if you don't turn up, the session counts as used.
- I understand real emergencies happen. I may waive this rule at my discretion, but that doesn't change it for next time.
7. If I need to cancel
If I cancel or can't attend a session, I'll give you as much notice as I can and you can choose to reschedule it, carry it into next month, or get a refund for that session. If I'm unavailable for an extended period, such as illness or travel, I'll pause your package so you don't lose anything.
8. Switching, pausing and ending
- Packages run month to month. There's no minimum term.
- To switch packages, including between in person and online, pause, or cancel, give at least one week's notice before your next month starts. The change applies from that month.
- If you're injured or unwell and can't train, tell me as soon as possible. With a medical certificate, I'll pause your package mid-month and carry unused sessions forward.
- Your client app access stays active while your package is active, and for 30 days after it ends so you can download your records.
9. Refunds
- Payments for a month that has started aren't refundable, except under section 7 or 8, or where the law requires it.
- If you cancel with the required notice, you won't be charged for the next month.
- If I end our arrangement for any reason other than a serious breach of these terms, I'll refund any unused sessions you've paid for.
- Your rights under the Australian Consumer Law are not affected. If a service isn't provided with due care and skill, you may be entitled to a remedy.
10. Your health and safety
- Before we start, you'll complete a health and fitness questionnaire. Please answer it fully and honestly, and tell me straight away about any new injury, illness, medication, pregnancy or change in your health.
- If your answers suggest it, I may ask you to get clearance from a doctor before we train. I may also stop or change an exercise at any time if I think it's unsafe for you.
- Tell me immediately if you feel pain, dizziness, chest discomfort or anything unusual during a session. You're always free to stop.
- I'm a personal trainer, not a doctor, physiotherapist or dietitian. My advice doesn't replace medical advice.
11. Online coaching and the app
- For online coaching, you train on your own and are responsible for using suitable equipment and a safe space. Follow the program as written, and ask me if anything is unclear or feels wrong.
- Monthly video calls follow the same 24-hour rescheduling rule as sessions.
- I aim to review check-ins and reply to messages within 1 to 2 working days. Messaging isn't for urgent or medical issues.
- Keep your app login private. Accounts are for one person only.
12. Conduct
I'll always treat you with respect, and I ask the same. I may end our arrangement, with a refund of unused sessions, if a client is abusive, harasses anyone, or repeatedly breaks these terms. If you train at a partner gym or your building's gym, you also need to follow that venue's rules.
13. Results
I'll do my best to help you reach your goals, but results depend on many things, including how consistently you train, your nutrition, sleep and health. I can't guarantee a specific result, such as a certain amount of weight loss, in a certain time.
14. Liability
Exercise carries some risk of injury. I take care to train you safely and within your ability. To the extent the law allows:
- I'm not responsible for injury, illness or loss caused by information you didn't tell me, by not following my instructions, by training on your own, or by the condition of equipment or facilities I don't own or control.
- I'm not responsible for loss or damage to your personal belongings during sessions.
- My total liability to you for anything else is limited to the amount you paid me in the three months before the issue arose.
Nothing in these terms limits my liability for death or personal injury caused by my negligence, or any liability that can't be limited by law.
15. Your program and content
The programs, workouts and materials I create for you are for your personal use. Please don't share, sell or republish them. Photos, videos and information you upload stay yours. I only use them to coach you, as explained in my privacy policy.
16. Privacy
How I collect and protect your personal and health information is covered in my privacy policy. I won't use your photos, name, results or testimonial publicly without your separate written permission.
17. Law and disputes
If you have a problem, please talk to me first at [email protected]. Most issues can be sorted quickly and fairly.
These terms are governed by the laws of Queensland, Australia. This doesn't take away any protection you have under the mandatory consumer laws of the country where you live or where the service is provided.
18. Changes to these terms
I may update these terms from time to time. The "last updated" date shows the latest version. I'll give current clients at least 30 days' notice of any significant change, and it will apply from your next month. If you don't agree with a change, you can cancel before it takes effect.
